Nullification Puts Washington Back on its Leash
If someone tries to take away your right to think for yourself, to decide how to live, and to speak your mind, will you just give in and let them take it?
That is really the central question in American politics today. The federal congress is doing everything it can to take your rights away. Nullification is the answer to that challenge. It allows the states to refuse to enforce - and you to refuse to obey - bad legislation improperly imposed by congress.
At rock-bottom, it is a legal doctrine that gives you, as an individual, the lawful right - and the power - to organize and work to oppose unjust and illegal attempts by government on your Life, on your Liberty, and on your right to own Property.
Fighting Tyranny Pays!
Opposing tyrants has always come at a price - but so has not opposing them! Calculate which cost is greater among those two choices - and which one you are more willing to pay.
Those who fight tyranny inspire others to do the same - and that's how they vastly improve their chances of staying free. Yes, their opponents may single them out and make life difficult for them - but history proves that tyrants will do far worse if people don't fight back.
In this country, we have certain guaranteed rights, and the most basic ones are those listed above. Your government is supposed to be one of limited powers, and its proper job is to protect these right - not to take them away.
Yet, the federal congress has been on a dangerous course for decades. It is trying to 'legislate' them out of existence, bit by bit, one slice at a time.
Congress is the Modern Tyrant
The current congress' and president's attempts to force "Stealthcare" down our throats is just the latest example. Another one is the so-called "Patriot" Act that destroys the sanctity of your home and the privacy of your papers and personal effects.
Both political parties are guilty of this. Democrats like Stealthcare and hate the Patriot Act. Republicans like(d) the Patriot Act and hate Stealthcare. Yet, both congressional acts destroy your freedom. That's how Washington works.
Have you noticed how the Democrats that used to rail against the Patriot Act all the time under president bush are now deathly silent on the issue? Did the Patriot Act go away? No, it didn't. But the Patriot Act gives power to those who run Washington, and the Democrats are currently running it - so they "forgot" how bad it is.
How does Nullification fit into this picture? What concrete, legal and constitutional powers do you have to oppose such attempts on what essentially is your life? That is the subject of this website, and we will focus on both the theoretical-legal as well as the political-personal aspects of it.
Is Unjust Legislation Binding?
Re-read the US Supreme Court's pronouncement at the top of this page. Unconstitutional acts of congress are not law. They are null and void. Hence, the name of this website. The Nullification Power is simply your - and your state government's - way of reminding congress of that fact. It puts an emphatic "STOP!!" to the improper enforcement of unauthorized federal acts within states' borders. In other words:
Nullification is legal. Unconstitutional acts of congress are not!
It's all a question of balance. Our system is a system of checks and balances. You learned that in grade school. However, when the US congress:
- colludes against the people of the states,
- passes legislation it has no lawful authority to pass,
- when the president presumes to enforce those unauthorized acts on people in the states, and
- when the US supreme court simply rubberstamps these federal excesses,
then the several states and the people in them - you and me and our power of Nullification - are the only 'check' left that can right Washington's wrongs and restore America's proper balance of power.
It Can Be Done - Legally
Just because an official case of overt State-Nullification of a federal law hasn't effectively occurred since the 1830s, that doesn't mean it can't be done now. It also doesn't mean that it can't be done legally.
It can indeed be done - and it must be done. The only real alternative is to just give in and make the old Hobsons choice between outright socialism (under Democrat rule) or bare-boned fascism (under "big tent" Republicans). Neither choice is very appealing - and they are both un-American.
The Debate
Opponents of the doctrine constantly dredge up the fact that in the early 1800s, Nullification was practiced by South Carolina in its efforts to keep the North from imposing onerous tariffs. From that resulted a national rift that later led to the secessionist movement in the old South and ended in the Civil War and the (unconstitutional) imposition of the fourteenth amendment.
Opponents insinuate that because the Civil War is indelibly joined at the hip with slavery and later civil rights issues, states wanting to nullify unconstitutional acts of Congress will somehow "bring slavery back."
Will it really? If so, exactly how? Opponents never bother to answer these questions (and proponents often forget to ask them).
Proponents of Nullification, on the other hand, say the federal government has gone insane with a desire to control individuals’ lives at every turn. Washington continues to do this and it does it regardless of which major political party is in control. They point to the fact that merely voting one or the other party into power has proven to be more than just unsuccessful. It has proven disastrous.
In doing what it always does, the federal congress has invaded the constitutionally reserved lawmaking powers of the states. Proponents therefore say that Nullification is a proper way to restore the constitutional and historical balance of power between congress and the people in the states.
Independent state governments are a bulwark against federal overreaching - but they require independent citizens!
Where Do You Stand?
Neither slavery nor civil rights abuses have anything to do with the modern Nullification movement. No state today wants to go back to the 1800s or even to the 1950s.
Do you?
If you do, this may be the wrong website for you.
But if you want to keep living as a free American, you are definitely in the right place. Nullification will not bring white-on-black slavery back. It will, however, keep the lunatics who are running the mad house in DC from enslaving all of us in the name of 'whatever'.
Ultimately, the question boils down to who decides what's constitutional. In other words, who gets to have the final say?
If your answer is "the people in the states and their elected state governments" you are a proponent of Liberty.
If your answer is "the US Supreme Court, and nobody else", you have just given the supreme court the powers of a despot. Our constitutional system forbids such power.
If you agree that the supreme court should have the final say, and the supreme court gives in to congress and grants it too much power over you, who gets to check its power?
No one. Say goodbye to Freedom.
However, if you believe that the people and their state governments have the final say, then you have an effective way of combating federal government collusion and power grabs.
The good news is that the law is on the side of people who believe in freedom, and that is what this website is here to show you.
What’s My Beef in All This?
So, what's my beef in all of this? I came here from Germany in 1981 because I watched my birth country getting sucked into the gutter of quasi-socialism - and it happened almost without a fight. I knew nothing of America’s founding history or of the principles embedded in the Constitution back then, but I knew this country was freer than any other I had seen or heard of. So I came here.
After I got here, it took years before I learned out that it was America's founding history and the Constitution that grew out of it that made this country so free. One would think that I would have learned about that in law school. After all, they do teach "Constitutional Law I and II" there, but what I learned was far from it. Instead, I learned that the Supreme Court early on arrogated itself to being the 'final arbiter' of constitutional questions - under the strenuous protest from "fringe candidates" like Thomas Jefferson.
I also 'learned' that the Bill of Rights doesn't really mean what it says when it states that "Congress shall make NO law respecting an establishment of religion ..." - and pretty much everything else that comes after that.
I "learned", instead, that the only things in the Constitution the Founders really meant were those that offer ways around these clear and straightforward prohibitions - you know,like the "necessary and proper" clause or the "interstate commerce clause", or the "supremacy clause".
Funny how that works, isn't it? In law school, you learn that the Founders never meant what they wrote in the clearest and most unambiguous passages of the document. The only real meaning of the Constitution, they teach you, lies in the weasel-words that allow courts and the government to take more power from individuals and states.
Because of 'teachings' like that, it is now no longer a mystery to me why, over the nearly three decades after my arrival, America followed the same ignominious downward path that Germany had taken. But trust me, I'm not going back to Germany - nor anywhere else. This is my country now.
I am convinced that this time and place in history is when and where the age-old fight between individual freedom and the looming collectivist Utopian nightmare will be decided - and I am convinced that the outcome of this Nullification debate will seal America’s fate, either way.
So I put up this web site.
What This Site Will Do
It is designed as a platform where people and groups from different states who share my desire for
Freedom can come together and pool their knowledge and their passion and drive for freedom, encourage each other, and share
their strategies and resources so that the corporate-dominated power structure in DC can finally be put back in its place.
The fact is that:
- Nothing in the Constitution allows the federal government to dictate what type and how much health
insurance they must buy - especially not on penalty of actual jail time if they refuse.
- Nothing allows it to print electronic money by the trillions to bail out the banks and investment houses that caused the financial crisis - while saddling present and future generations
of Americans with having to foot the bill for decades out.
- Nothing authorizes Congress to pass laws that allow the FBI to tap your phone, read your email, and enter your home while you’re gone, search it, download your computer files, and
leave without a warrant and without even telling you they were there - or snag you and hold you indefinitely in a secret location as an allegedly "enemy combatant."
Yet, the federal government is doing all of the above - and with the sanction of the US Supreme Court!
The federal political and legal processes have been completely co-opted by corporate media, corporate
donors, special interest groups, and their lobbyists. American voters can’t compete with that kind
of influence in DC - so State and Individual action is the only answer left. If that upsets the
establishment’s apple cart, so be it. Of course they are against it!
If you read this, you likely share my desire for Freedom. I know that I can’t be free unless everybody else
around me is free as well - so here’s to you. I hope - I pray - that this site provides you with what you need so that, together, we can win this fight. If it doesn’t, I only ask that you help me to improve it - so that it will.
